SafeCycle Terms of Service

These Terms of Service ("Terms") govern your use of the SafeCycle mobile application (the "App"), operated by Matthew DiPaola ("we," "us," or "our"). By creating an account or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use SafeCycle. If you are under 18, you represent that you have your parent or guardian's permission to use the App and that they have reviewed these Terms and our Privacy Policy. If you are under 13, you may not use the App.

2. Your Account

You must provide accurate information when creating an account and keep your credentials secure.
You are responsible for all activity that occurs under your account.
You must choose a username that is not offensive, misleading, impersonating, or infringing. We may reject or reclaim usernames at our discretion.
Notify us promptly of any unauthorized use of your account.

3. Community Content and Conduct

SafeCycle depends on user contributions. When you post spots, reviews, ratings, photos, or other content, you agree that you will not:

Post false, misleading, or intentionally inaccurate parking or safety information.
Upload content that is offensive, harassing, hateful, threatening, obscene, or otherwise inappropriate.
Post content that infringes anyone's intellectual property, privacy, or other rights.
Upload photos that contain other people without their consent, or that reveal private or sensitive information.
Use the App to harass, stalk, track, or endanger any person.
Attempt to disrupt, hack, overload, or reverse-engineer the App or its infrastructure.
Use automated means to scrape, collect, or submit data without our permission.

We use an automated word filter and human moderators to help keep content appropriate, but we do not review all content and are not responsible for user-generated content.

4. Content You Post

You retain ownership of the content you create.
By posting content, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content within the App for the purpose of operating and improving SafeCycle.
You represent that you have the rights to the content you post and that it does not violate these Terms or any law.

5. Moderation and Enforcement

We and our moderators may edit, hide, or remove any content, and may suspend or terminate accounts, that violate these Terms or that we consider harmful to the community — with or without notice. You may report inappropriate content within the App.

6. Safety Disclaimer — please read.
SafeCycle provides community-contributed information about bike-parking locations. Safety ratings, lighting and visibility assessments, and other details are the opinions of individual users and are not guarantees of safety or security. Conditions change, and information may be inaccurate, outdated, or incomplete. We do not guarantee that any location is safe, secure, or free from theft, damage, or other risk. You are solely responsible for deciding where and how to park and secure your bike, and you use the App and any information in it at your own risk. Always use your own judgment and appropriate locks and precautions.

7. No Warranty

The App is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or that information in it is accurate or reliable.

8. Limitation of Liability

To the fullest extent permitted by law, Matthew DiPaola and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss (including bike theft or damage, personal injury, or loss of data) arising out of or related to your use of, or inability to use, the App or any content in it — even if we have been advised of the possibility of such damages. Where liability cannot be excluded, it is limited to the maximum extent permitted by law.

9. Third-Party Services

The App uses third-party services (including Supabase and OpenStreetMap/Nominatim) and may open external apps such as your device's maps application for navigation. We are not responsible for third-party services or their content.

10. Termination

You may stop using the App and delete your account at any time. We may suspend or terminate your access to the App at any time if you violate these Terms or if we discontinue the App. Certain provisions (including Sections 6, 7, 8, and 11) survive termination.

11. Changes to These Terms

We may update these Terms from time to time. We will revise the "Last updated" date and, where appropriate, notify you in the App. Your continued use of the App after changes take effect means you accept the updated Terms.

12. Governing Law

These Terms are governed by the laws of the State of New York, USA, without regard to its conflict-of-laws rules, except where local mandatory consumer-protection laws apply to you.
